 Post subject: Tenant skipped and owes me rent

Hi, I hope you can help me. My tenant signed a lease August 1st for my rental in Ocala Florida. She paid her rent every month until November. She promised she would pay it by the 15th, but she didn't. :( Yesterday I received an email from her saying she had moved out and was mailing me the keys. Her rent was $1200 per month. What should I do? Can I make her pay me rent through July 2010, since she broke the lease? Thanks for your help. Lisa, Lakeland Florida

If your lease is a standard Florida lease she will owe you rent until the unit re-rents. Did she have a deposit? If she did make sure you comply with state law and send her a deposit disposition within the proper time period. The statement should include verbiage that informs her that each day the unit is not re-rented she will owe you additional rent. The first of each month I recommend you send her an updated statement showing her new balance.

Let me know once the unit is re-rented and I will tell you your options to collect what she owes you.

Ouch! This is a tough time of year to get hit like that.

Bill is right, legally tenant is responsible for the rent each month until you re-rent or the lease term ends. In the meantime, here is a link to our website which gives you step-by-step directions when your tenant vacates your place in Florida. It's a long article but every step is crucial -- especially the Security Deposit Letter (if you don't have one you can download free from the website).
