 Post subject: Tenant Vanished, Husband Didn't!!!

I have a lease in SC that is signed by a lady who left her husband this past weekend (she signed as tenant, he signed as witness, and they are both listed as occupants). According to him, she got a big bonus from work, packed her belongings, and left (current whereabouts and phone number unknown but most likely still in town). She has not paid this month's rent and, judging by her behaviors, she has no plans to pay me another cent. She has ignored my emails requesting payment (plus late fees). I can't even tell you how nice I was to these complete strangers. I gave them a place to stay when they had no money and voluntarily waived the first months rent ($1250) out of pure sympathy. I have two small toddlers to support, we have been saving pennies to build a house in the spring, and this is just an awful time for this. With a $1400 mortgage, our savings won't last long and we will have to start over.

I have a $1250 deposit from them (which I have just spent on this month's mortgage). I do not have their social security numbers. I have no lawyer and I'm not a professional landlord. I vacated this house when I got married and was forced to rent it because I could not sell (the economy left me upside down on the house).

So what should I do? The husband is communicating and behaving decently so far, he has nowhere to go, and I don't want to just kick him out on the street. He has agreed to be out by March 1 and have the house cleaned up. I'm ignorant in this arena but I do realize that I need to be very careful here. My current plan is to claim abandonment on March 1 (I am assuming and praying that the husband will be gone then as promised), put the house on the market, and file a suit against the tenant in small claims court.

Joel,

I am sorry you are in this position, but I have to tell you, being a nice guy has gotten you into trouble here. You have been over the top nice. If you do not have their Social Security numbers I assume you did not look at their credit. Also anyone over 18 living in the rental must sign the lease. The minute you decided to rent your house to someone you became a professional landlord.

If I were you there is no way I would let him stay until the end of the month for free. You have gone way to far with the kindness. Get him out now and ready the house to sell. If you don't you may very well be prolonging the problem and the cost. If he has nowhere to go today, what is going to change by March 1st? If he has nowhere to go March 1st are you going to let him stay another month?

Again I appreciate your compassion, but this has turned into a hand out. You can't let it continue or you will find yourself broke quickly.

I realize you said you're not a professional landlord, but maybe something to remember in case a similar situation comes up. Always get a rental application completed ahead of time and be sure it contains emergency phone numbers and information. That information can be used to track people down who disappear on you. I just called the mother of a tenant who's cell phone came back disconnected. She unhesitatingly gave me the new cell phone number. Good info to have on file. FYI

Thanks for the responses. I'll get emergency contact information next time with SS numbers and I have scheduled a date to have the locks changed.

So, should I take the matter of rent owed to small claims court, hand the debt off to a collector, or just try to think happy thoughts?

Do they still have rights to the deposit money if the house is in good shape?

Hi Joel,

Have you checked South Carolina law as to how to legally change the locks? Make sure you do before you proceed.

As for the security deposit read this link to South Carolina law: http://www.scstatehouse.gov/code/t27c040.htm

Accrued rent may be deducted from the deposit. Make sure you fulfill any notification requirements after move out. When did the lease start and when does it end? You may also be entitled to rent through the end of the lease or when you re-rent depending on which comes first. It doesn't sound to me like this tenant will be getting any of the deposit back.

And yes think happy thoughts. Don't get discouraged, there is a great tenant out there for you. You just need to bone up on some things and stop being such a nice guy (when it comes to renting). You can be both a good guy and a landlord, just put your pocketbook and family first.
